CIPD Employment Law (Generalist Elective)

Intended to take your expertise in HR management to the next level, this elective course comprises one of  the four modules of the CIPD Professional Development Scheme (PDS). Employment law is a dynamic field, and this course will give you the skills you need to keep up with and respond to changing legislation. You'll learn to apply employment law in ways that will benefit your oganisation, creating personnel policies that account for and anticipate changes to current laws. This advanced qualification is intended to prepare you for eventual entry into senior management, and as such will equip you with advanced management and development skills that can be applied to all areas of business.

 

What will I study?

Themes and Institutions of Employment Law

  • Examine the main themes and institutions of employment law, focusing particularly on the differences between civil and criminal law, and the UK system of courts and tribunals.

Individual Employment Rights

  • Consider the statement of initial employment particulars; contractual terms; mutual duties of the employer and employee; the payment of wages; rights to time off work; Working Time Regulations; and maternity rights.

Intellectual Property and Confidential Information

  • Consider the duty of the employee not to disclose confidential information, and the duty of the employer to provide a reference. Study the Data Protection Act 1998 and the Access to Medical Records Act 1988.

Equal Opportunities

  • Examine sex and sexual orientation legislation; age, race and religion/belief legislation; disability discrimination; equal pay legislation; and discrimination on the grounds of trade union membership or non-membership. Consider bullying, harassment at work and the need for specific policies.

Health and Safety at Work

  • Examine UK and EU law on health and safety, and the rights and obligations of employers and employees. Consider the causes and effects of stress.

Termination of Employment

  • Consider the different ways in which a contract of employment can be discharged, as well as wrongful and unfair dismissal, redundancy, and TUPE.

Trade Union Law

  • Study trade union recognition and derecognition, trade union law and picketing.
